Dear Sam:
 
I know you like to play the common man role, but you would really make things better if you gave out a fax and phone number for your office at the Tribune. Contacting you through the newsroom seems somewhat antithetical, what with you downsizing and all. (Is Rick Pearson gone yet? Big savings that.)
 
I am writing to ask you to "free" the Los Angeles Times tape that has engendered so much controversy and interest this week.
 
Publishing a newspaper is a public trust, as the Wall Street Journal reminds its readers each January.
 
Since you are a law graduate, I will assume you retain familiarity with basic principles of law.
 
It is a fundamental principle of fiduciary law that a public trustee should not enter into contracts that either are contrary to the interests of the trust beneficiary (in the case of a newspaper, the public), create conflicts between the trustee and beneficiary or are contrary to public policy. The so-called "confidentiality agreement" entered into between someone (who) at the Times and the source of the tape was an agreement which violated all three of the foregoing principles. It is contrary to public policy and unenforceable.
 
Public sentiment is overwhelmingly in favor of releasing the tape. So, in the interest of the beneficiaries of the public trust you hold, the decision is a no-brainer.
 
Please publish and release the tape.
